Asia Collegiate Basketball Limited ("ACBL", "we", "us", or "our") recognizes and understands that customers, website visitors, and mobile application users (“you” or “your”) are concerned about the privacy of personal data. We will comply with the requirements of the Personal Data (Privacy) Ordinance (Cap. 486) (the “PDPO”) of the Laws of the Hong Kong Special Administrative Region of the People’s Republic of China (“Hong Kong”).
This Privacy Policy Statement should be read together with the Terms and Conditions of the relevant service, website, and/or mobile application provided by us (the “Terms and Conditions”) and the Personal Information Collection Statement (“PICS”).
1. Collection of information
You may be invited to provide your personal data on ACBL's website or mobile application(s) or through other media on a voluntary basis for different purposes at different times. If you are under the age of 18 or a minor under applicable laws in your jurisdiction, we strongly advise you to submit personal data or request to use our products or services via your parent or guardian. Consent from your parent or guardian must be obtained before your personal data is provided to us.
2. Personal Data
The kinds of personal data we may collect from you include your telephone number, email address, name, gender, mailing address, IP address, credit card and/or other payment methods and billing information, including name, card number, billing address, expiry date, verification code and other payment details etc.
3. Purposes for using personal data
We will use your personal data for the purposes identified in the PICS provided to you on or before the collection of your personal data. This includes sharing your personal data with, and your personal data being used by, third parties including our service providers as set out in the PICS for those purposes.
4. Direct marketing
Subject to your consent, we may use or provide third parties (whether to our affiliates and/or external parties) your personal data for direct marketing purposes in accordance with the PICS provided to you on or before collecting your personal data.
5. Accuracy of information
You may be requested to provide ACBL certain personal data (particularly relating to your contact information) for specific services. If you fail to provide or update accurate information as requested for each specific service, the provision of such services by ACBL may be affected.
7. Use in legal proceedings
We may disclose your personal data as required by law, any government departments, regulatory authorities, enforcement agencies and courts of competent jurisdiction. We exclude all liability for disclosure of your personal data in this manner. If it becomes necessary for us to take action against you for recovering from you the debt you owe to us, you agree that your personal data can be used by us in identifying and taking legal action against you.
8. Retention of information
We will retain your personal data for a period no longer than necessary for the fulfilment of the purposes for which they are to be used. The above is subject to any legal, statutory, regulatory or accounting requirements.
9. Access to and correction of information and withdrawal of consent
You have the right to:
- check whether we hold any of your personal data;
- access your personal data held by us;
- require us to correct any personal data which is inaccurate;
- ascertain our policies and practices (from time to time) in relation to personal data and the types of personal data held by us;
- withdraw your consent to the use of your personal data for direct marketing purposes.
All such requests will be handled promptly in accordance with the requirements of the PDPO. We may charge you a reasonable fee for processing your personal data access request.
12. Linking with third parties
Please be aware that our website, mobile applications or other platforms may contain links to other sites hosted by third parties. Different rules may apply to their collection, use, or disclosure of your personal data. These third-party sites may collect cookies which can identify you as an individual when you are logged in to their services or products. We do not control these cookies or how those sites collect and handle your personal data. We encourage you to review such third-party websites’ policies before revealing any personally identifiable or sensitive information or purchasing any services or products. We are not responsible for the content or privacy practices and policies of those other sites and under no circumstances shall we have any liability whatsoever for the activities conducted by or at any site accessed from or through our website, mobile applications or other platforms.
13. Change of control
In the event of any actual or proposed transfer of business, transfer of shares, re-structuring, amalgamation, merger, sale, transfer or purchase of us or our business or our affiliates or our Affiliates’ businesses, ACBL may need to transfer your personal data to the new entity in accordance with the PICS. You will be notified of such event and you may decide to withdraw your consent to the use of your personal data.
15. Miscellaneous
This Privacy Policy Statement may be updated from time to time to reflect changes to our policy with respect to personal data protection and/or changes to personal data/data privacy laws and regulations.
Nothing in this Privacy Policy Statement shall limit your rights under the Personal Data (Privacy) Ordinance of the laws of Hong Kong.
This Privacy Policy Statement shall be governed by, and construed in accordance with, the laws of Hong Kong.
16. PRC Addendum
If you are:
(i) an individual located in Mainland China who visits our website or uses our mobile applications, or otherwise uses our products and/or services by phone or any other means from Mainland China; and/or
(ii) (ii) an individual holding a Mainland China passport and/or resident identity card who visits our physical offices in Hong Kong or otherwise use our products and/or services by phone or any other means in Hong Kong,
your personal data will be processed by ACBL in accordance with the “People’s Republic of China Addendum” in addition to this Privacy Policy Statement and the PICS, as well as the applicable data protection laws and regulations in Mainland China which, for the current purposes, excludes Hong Kong, the Macau Special Administrative Region of the People’s Republic of China and Taiwan.

People’s Republic of China Addendum
1. Application
If you are:
a) an individual located in Mainland China who visits our website or uses our mobile applications, or otherwise uses our products and/or services by phone, internet or any other means from Mainland China, and/or
b) an individual holding a Mainland China passport and/or resident identity card who uses our products and/or services by phone, internet or any other means in Hong Kong,
your personal data will be processed by us in accordance with this Addendum in addition to ACBL’s Privacy Policy Statement (hereafter, the “Privacy Policy Statement”) and ACBL’s Personal Information Collection Statement (hereafter, the “PICS”), as well as the applicable data protection laws and regulations in Mainland China.
For the purpose of this Addendum, “Mainland China” refers to the People’s Republic of China excluding Hong Kong, the Macau Special Administrative Region of the People’s Republic of China (“Macau”) and Taiwan. Unless defined otherwise, all defined terms (capitalised terms) in this Addendum shall have the same meaning as the defined terms in the Privacy Policy Statement and PICS.
In the event of any conflict or inconsistency, they shall be resolved in the following order of precedence (from higher to lower): (a) this Addendum; (b) the Privacy Policy Statement and PICS.
2. Personal Data
In this Addendum, “personal data” refers to various information related to an identified or identifiable natural person recorded electronically or by other means and does not include anonymised information. Personal data involved in this Addendum includes those set out in Paragraph 2 of the Privacy Policy Statement and those set out in the PICS.
Certain personal data that ACBL collects may be “sensitive personal data” as defined in the applicable data protection laws in Mainland China, which is personal data that, once leaked or illegally used, may easily lead to violation of the personal dignity of a natural person or harm of personal or property safety. This includes residential address, marital status, biometric data, activity log files, Mainland travel permit, username, password, location data and transaction information (including your characteristics and transaction behaviour). “Process” or “processing” of “personal data” includes the collection, storage, use, processing, transmission, provision, disclosure, deletion, etc. of “personal data”.
3. How We Collect and Process Your Personal Data
a) Your personal data will be processed by ACBL for the purposes as further specified below and set out in the relevant PICS (“Purposes”). In particular, for us to carry out the Purposes and provide you with the relevant products/services, the personal data (including sensitive personal data) set out below is necessary. If such information is not available or not accurate, we may not be able to provide the relevant products/services.

- Volunteer or Staff Recruitment: Name, Contact Info, Background Info
- Legal Compliance & Record Keeping: Identity Info, Transaction History
b) In general, we process your personal data with your consent, and where appropriate, with separate consent from you for processing your personal data under specific circumstances required by the applicable data protection laws and regulations in Mainland China. You acknowledge and agree that under the following situations, we are not required to obtain your consent to process your personal data:
i) the processing is necessary for the conclusion or performance of a contract to which you are a party, or where it is necessary to conduct human resources management according to lawfully formulated labour rules and lawfully concluded collective contracts;
ii) the processing is necessary for the performance of our duties or obligations under any applicable laws and regulations, including those directly related to:
1) national security and national defence;
2) criminal investigation, prosecution and trial and execution of court orders, judgments or related matters; or
3) public security, public health, or major public interest;
iii) processing is necessary for responding to public health emergencies, or for the protection of life, health and property safety of natural persons under emergency circumstances;
iv) the personal data is processed within a reasonable scope to conduct news reporting, supervision by public opinion and other activities in the public interest;
v) the personal data is made available to the public by you or the personal data about you from legitimate public sources is processed within a reasonable scope in accordance with the laws and regulations; or
vi) other circumstances as provided by the laws and regulations.
4. Your Rights
In accordance with the applicable data protection laws and regulations in Mainland China, you may exercise the following rights over your personal data, including to:
a) request to delete your personal data if:
i) our processing of your personal data breaches laws or regulations;
ii) we collect or use your personal data without your consent;
iii) our processing of your personal data breaches our agreement with you;
iv) you no longer use our products and/ or services, or the purposes for collection described in this Addendum have been achieved or accomplished;
v) you withdraw your consent;
vi) we no longer provide products and/or services to you;
b) change the scope of your consent;
c) obtain a copy of your personal data; or
d) request to transfer your personal data to another personal data processor provided that such request is compliant with the applicable laws and regulations.
However, please note that we may refuse your requests under the following circumstances:
a) circumstances relevant to the fulfilment of our obligations under laws and regulations, including our provision of your personal data (including your sensitive personal data) generated during the transaction between you and us to the regulatory authority(ies) and or other governmental departments under the laws and regulations of Mainland China;
b) the data retention period required by any law or administrative regulation has not expired, or it is difficult to delete personal data technically (in such cases, we will take necessary security protection measures to ensure the security of your personal data or anonymise such personal data);
c) circumstances directly related to national security and defense security;
d) circumstances directly related to public security, public health, or significant public interest;
e) circumstances directly related to criminal investigation, prosecution and trial, and execution of court decision;
f) circumstances where we have sufficient evidence to prove that you have subjective malice, or you are abusing your rights;
g) circumstances where protection of your or other individual’s life, property and other important lawful rights is involved;
h) circumstances where responding to your request will cause serious harm to the lawful rights and interests of you or other individuals or organisations (including us); or
i) circumstances where trade secrets are involved.
5. Retention of Personal Data
Your personal data will be kept by us for no longer than necessary for the fulfilment of the Purposes.
7. How We Store and Transfer Your Personal Data
In principle, we collect, produce and process the personal information in Mainland China in accordance with the business purposes set out here. You understand, authorise and consent that we may transfer your personal information outside Mainland China to our headquarters in Hong Kong and to our Affiliates, Marketing Partners and other service provider entities outside Mainland China), due to business needs and solely for achieving the business purposes and to the maximum extent permitted by law and in accordance with the mandatory requirements under the laws and regulations of the Mainland China.
a) Transfer with separate consent. After obtaining your separate consent, we will transfer your personal data to other parties in accordance with this Addendum;
b) When we are involved in any actual or proposed transfer of business, transfer of shares, re-structuring, amalgamation, merger, sale, transfer or purchase of us or our business or our Affiliates or our Affiliates' businesses (please refer to the PICS and the Privacy Policy Statement);
c) We may otherwise transfer your personal data in accordance with applicable laws and regulations, requirements under legal proceedings, compulsory administrative or judicial requirements.
8. How We Process Minors’ Personal Data
If you are under the age of 14, you must obtain the explicit consent of your parent or legal guardian before giving us any personal data about yourself. If parents or legal guardians are aware that personal data of any individuals under the age of 14 under their care have been provided to us without consent, please notify us immediately to delete such personal data.
